If You do not agree to the Terms then You are not authorised to use the Site and the Services. Your use of the Site and the Services will be deemed acceptance of the Terms.
EnglishPortugueseJobs.com (“EPJ”) may from time to time revise the terms, EPJ therefore advises that You read this page periodically to review the Terms, because any changes will be binding on You.
Your use of this Site and Service
You are authorised to view and use the Site and the Services, provided it is for lawful purposes relating to seeking employment, information, or advertising solutions.
You may not use the Site for any other purposes to transmit, distribute, store or destroy any material posted on this Site. You ensure that any information that You send to EPJ or to any advertiser, it is accurate and legal.
You are prohibited from:
- posting any material that may infringe any personal right, copyright, moral right, database right, trade mark, patent or any other intellectual right held by any party;
- posting any material that contains any viruses, worm or Trojan horse so as to cause any disruption to the Site;
- posting any material that contains any data, image or otherwise which is offensive, obscene or indecent or capable of being offensive, obscene or indecent;
- posting any incomplete, false or inaccurate information, or information that is not your own;
- posting any franchise, pyramid scheme or setting up any other business opportunity.
A Job posting may not contain: (a) any hyperlinks, other than those specifically authorised by EPJ in writing; (b) misleading, unreadable, or “hidden” keywords, repeated keywords or keywords that are irrelevant to the job opportunity being presented, as determined in EPJ’s reasonable discretion; (c) the names, logos or trademarks of unaffiliated companies other than those of your customer save where expressly agreed in writing by EPJ; (d) the names of places that are unrelated to the posting; (e) more than one job or job description, more than one location, or more than one job category unless otherwise agreed in writing by EPJ; (f) inaccurate, false, or misleading information; and (g) material or links to material that exploits people in a sexual, violent or other manner, or solicits personal information from anyone under the age of 16.
You must not use any job posting to: (a) post jobs in a manner that does not comply with applicable local, national and international laws, including but not limited to laws relating to labor and employment, equal employment opportunity and employment eligibility requirements, data privacy, data access and use, and intellectual property; (b) post jobs that require citizenship of any particular country or lawful permanent residence in a country as a condition of employment, unless otherwise required in order to comply with law, regulations, executive order, or federal, state or local government contract; (c) post jobs that include any screening requirement or criterion in connection with a job posting where such requirement or criterion is not an actual and legal requirement of the posted job; (d) post jobs or other advertisements for competitors of EPJ or post jobs or other content that contains links to any site competitive with EPJ; (e) post any business opportunity that pays commission only unless the posting clearly states that the available job pays commission only and clearly describes the product or service that the job seeker would be selling; (f) endorse a particular political party, political agenda, political position or issue or promote a particular religion or request (except where permitted to do so by applicable law) any information relating to his/her (i) racial or ethnic origin (ii) political beliefs(iii) philosophical or religious beliefs (iv) membership of a trade union (v) physical or mental health (vi) sexual life (vii) the commission of criminal offences or proceedings or (vii) age.
EPJ reserves the right to remove, or amend, any job posting or content from the Site, which in the reasonable opinion of EPJ does not comply with some or all The Terms above, or if any content is posted that EPJ believes is not in the best interest of EPJ, or in extremely serious cases, EPJ reserves the right to immediately suspend or terminate Your account and access to the Site as well as removing such job posting or content.
Copyright and Intellectual Property
The contents of the Site and all other web sites that are under EPJ’s control are protected under UK copyright and are the property of EPJ.
EPJ does not grant any licence or other authorisation to any user of its trademarks, service marks, or other copyright works or intellectual property.
Privacy Statement and Data Protection
In accordance with the Data Protection Act 1998 EPJ follows security procedures for the storage and disclosure of information, which You have given to EPJ. Any personal information that You provide will be treated as confidential information by EPJ. Please note that any information that You provide to a third party will not be covered by EPJ’s Privacy Statement.
EPJ wants to provide as full a service as possible to recruiters posting job opportunities and services and for candidates posting CVs. EPJ does not makes any checks as to the vacancies offered nor is EPJ able to confirm the accuracy of information that any user provides.
EPJ excludes all liability in connection with any information that is provided by both advertisers, recruiters and candidates.
EPJ shall use its reasonable endeavours to ensure that the Site has satisfactory functionality, however EPJ cannot guarantee that the Site will be operational at all times, and as a result will not be liable for any failure or inability to provide a continuous, error free service.
EPJ does not make any representation whatsoever about any job postings or advertisements, which are accessed through the Site or via a link to another website. EPJ shall use its reasonable endeavours to ensure that the material on this website is accurate, but cannot accept any liability for the same as EPJ relies on information provided to it by third parties. EPJ advises that You must satisfy yourself as to the suitability of any candidate, agency, employer or job found through the Site.
Notwithstanding anything else contained in the Terms or on the Site, EPJ shall not have any liability to You in connection with the Agreement howsoever arising in respect of loss of profits or contracts or for special, indirect or consequential loss or damage, or for any increased costs or expenses.
You agree to defend, indemnify and hold harmless EPJ and its affiliates harmless from any and all claims, actions, proceedings, losses, damages, liabilities, costs and expenses, including reasonable legal fees, arising from your use of the Site and / or the Services.
Nothing in these Terms shall seek to limit liability for death or personal injury caused by EPJ’s negligence, fraudulent misrepresentation made by EPJ or any other statutory rights, which are not capable of being excluded.
EPJ shall not be liable to You for any direct, indirect, consequential, special or other damage to your computer systems or viruses, worms, trojan horses or other destructive methods, howsoever caused, resulting from use of the Site.
You agree that EPJ has the right at any time to deny or restrict access to the Site or access to third party services. EPJ shall not have responsibility to inform any third party providers of services of restricted or denied access.
No variation or alteration to the Terms are valid or have any effect.
The Terms shall constitute the entire agreement and understanding of the parties and supersede any previous agreement between the parties relating to the subject matter of the Terms.
You may not assign any of your rights and obligations under the Terms.
Nothing in the Terms shall oblige EPJ from discontinuing the Site or any other services provided through the Site at some future date.
If any of the provisions are held invalid, illegal or unenforceable for any reason, such provision shall be severed and the remainder of the provisions hereof shall continue in full force and effect as if the Terms had been executed with the invalid provision eliminated. In the event of a holding or invalidity so fundamental as to prevent the accomplishment of the purpose of the Terms the parties shall immediately commence good faith negotiations.
The Terms shall be governed, construed and shall take effect in accordance with the Laws of English; and shall be subject to the exclusive jurisdiction of the English courts.
